Your Agreement with myLifeLog
Your use of myLifeLog is governed by this agreement. "myLifeLog" means myLifeLog, located in Pleasanton, California, United States, and its subsidiaries or affiliates involved in providing myLifeLog℠ for use by United States residents. This Service Agreement applies to the myLifeLog℠ information site at www.mylifelog.org, which is referred to in these Terms and Conditions as the "Service." When you register and set up an account on the myLifeLog℠ website, you become a "Subscriber".
All content accessed through myLifeLog℠ is for informational purposes only, and is not intended to cover all possible uses, procedures, treatments, preventative care, disease management, drug interactions, or adverse effects. myLifeLog℠ does not provide medical advice. This content should not be used during a medical emergency or for the diagnosis or treatment of any medical condition. Please consult your doctor or other qualified health care provider if you have any questions about a medical condition, or before taking any drug, changing your diet, responding to environmental risk factors or commencing or discontinuing any course of treatment. Do not ignore or delay obtaining professional medical advice because of information accessed through myLifeLog℠. Please call 911 or consult your doctor if you have an actual medical emergency.
Your myLifeLog℠ Account
You can access our service in two ways. First, you may link to myLifeLog℠ through one of myLifeLog' affiliates or partners. Secondly, you can use our service directly through the myLifeLog.org Website. In both cases you will need to register and set up an account for first time use and ongoing access to your information.
You must provide accurate and complete registration information any time you register to use myLifeLog℠. You are responsible for the security of your passwords and for any use of your account. You must immediately notify myLifeLog of any unauthorized use of your password or account.
Your use of myLifeLog℠ and any content accessed through myLifeLog℠ must comply with all applicable laws, regulations and ordinances, including any laws regarding the export of data or software.
You may not access myLifeLog℠ other than by the interfaces provided by myLifeLog or its affiliates, or interfere with or disrupt the proper operation of myLifeLog℠.
We consider your use of the Service to be private and we refer you to the myLifeLog Privacy Statement for more complete information about how we treat privacy.
We may access or disclose information about you, your account, or the content of your communications in order to: (1) comply with the law or legal process served on us; (2) enforce and investigate potential violations of this Service Agreement, including use of this Service to participate in, or facilitate, activities that violate the law; or (3) protect the rights, property, or safety of myLifeLog, its employees, its customers, or the public.
In order to provide you the Service, we may record log information about Service performance, your machine, and your Service use (such as number of sign-ins and number of times a link was clicked). We may automatically upload this information from your machine. This data will not personally identify you.
myLifeLog will use aggregate data to publish statistical trends and associations. We will only share aggregate statistical information about health trends (such as the regional distribution of individuals with a particular disease) but not about individuals. We might also permit tools on your personal web space that allow you to show how some of your health parameters compare to aggregate information about the general population. This aggregate information does not contain personally identifiable information and therefore cannot identify any specific individual.
Use of myLifeLog℠ service and site information
myLifeLog and its Licensors grant you a limited, non-exclusive, personal, non-sublicensable, non-assignable license to use myLifeLog℠. Except as expressly permitted in this License, you agree not to disassemble, alter, duplicate, modify, rent, lease, loan, sublicense, make copies, create derivative works from, distribute, or provide others with the information in whole or part or transmit the information over a network that is not part of the myLifeLog service or to individuals or institutions that are not licensed to received this information.
You may only use myLifeLog℠ if and to the extent that it does not violate the laws of your place of residence.
Sharing your health information with others
If you share your information with others, you can view a list of who has access to your information and you can revoke sharing privileges at any time. When you revoke someone's ability to read your health information, that party will no longer be able to read your information, but may have already seen or may retain a copy of the information.
myLifeLog℠contains a directory of third-party websites that are capable of securely sending information to myLifeLog℠. These websites (which may include your medical provider) may give more information about certain conditions or extend the functionality of myLifeLog℠ in other ways. By creating a link to these websites, you give them permission to send you information such as health or medical records, prescription histories, or reports.
Some of these third-party websites will be covered by federal and state health privacy laws (such as the Health Insurance Portability and Accountability Act, or "HIPAA"), and those laws will govern how they may use and share your information. As a result, you must authorize these providers to send information to your myLifeLog℠ account. With that authorization, you also give them permission to send certain types of health information (such as mental health records) that are protected by federal and state laws and require special authorization. When you ask myLifeLog to send your health information to others, you will also be giving myLifeLog permission to send those certain types of health information.
Third Party Services
myLifeLog may make third-party services available through myLifeLog℠. In order to use a specific service, you may choose to allow the third-party service provider to retrieve, provide, or modify health and other information in your account or otherwise utilize or share your information with the service provider. Once you enable a specific third-party service provider to access your account, the service provider may continue to access your account until you affirmatively disable access. Third-party service providers may include both health care providers and other entities. It is your sole responsibility to review and approve each such third-party service before sharing your information through or otherwise accessing it.
myLifeLog may screen, modify, refuse, or remove certain third-party content or services, but is not responsible for and does not endorse any third-party content or services. Furthermore, myLifeLog does not endorse any third-party service providers, other health care providers, products, services, opinions, or web sites accessed through myLifeLog℠.
USE OF THESE SERVICES AND RELIANCE ON THIS CONTENT IS SOLELY AT YOUR OWN RISK. myLifeLog MAY NOT BE HELD LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF ANY THIRD-PARTY SERVICE OR CONTENT. Providers of these third-party services or content are myLifeLog' "Licensors".
Regardless of any other provision herein, the trademarks of myLifeLog and the names myLifeLog, and myLifeLog℠ shall not be used by the Subscriber in any way, especially not as a means of identifying the source of the service to public audiences or clientele. The only person who may use the trademarks of myLifeLog, or the myLifeLog names is one who holds a separate written trademark license agreement with myLifeLog.
myLifeLog owns all information, data, images, and other material comprising the myLifeLog℠ service, all of which are to be considered copyrighted by myLifeLog and remain the sole and exclusive property of myLifeLog. Subscriber is authorized to use such for the purposes stated herein and to store such information during the time of the Agreement.
Subscriber may not store for future use such information beyond that period, nor develop a library of such information. Users may download only one copy of the online material. Should users request and obtain permission from myLifeLog to use downloaded material elsewhere then logos and trademark names shall not be removed.
Third party information and privacy
Links to other sites are for information only and myLifeLog has no responsibility of the content on that site which may change without notice. Please be aware that myLifeLog is not responsible for the privacy practices of such sites. We encourage our users to be aware when they leave our site and to read the privacy statements of every Web site that collects personally identifiable information.
Disclaimer Warranty of information
Some of our data or information is based on numerous indicators and mathematical calculations. Systems and third party data and information may contain errors or uncertainty. myLifeLog makes no guarantee for error free information and assumes no responsibility for the action or inaction of subscribers to this information.
myLifeLog makes no express or implied warranties or affirmations that the information provided will occur or have occurred as the reports, graphics, data or information comprising the service state, represent or depict and it shall have no responsibility or liability whatsoever to Subscriber or any other person or entity, parties and nonparties alike, for any inconsistency, inaccuracy or omission for events predicted or depicted, reported, occurring or occurred. myLifeLog MAKES NO WARRANTIES HEREUNDER, AND THIS DISCLAIMER OF WARRANTIES INCLUDES, BUT IS NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
NEITHER myLifeLog NOR ANY OF myLifeLog' LICENSORS MAKE ANY WARRANTY THAT THE CONTENT IN MYLIFELog℠ SATISFIES GOVERNMENT REGULATIONS REQUIRING DISCLOSURE IF THE CONTENT INCLUDES INFORMATION ON PRESCRIPTION DRUG PRODUCTS, MEDICAL TREATMENTS OR PROCEDURES, OR ENVIRONMENTAL CONDITIONS. CONTENT IN MYLIFELOG IS DEVELOPED FOR USE IN THE UNITED STATES, AND NEITHER myLifeLog NOR ANY OF myLifeLog' LICENSORS MAKE ANY REPRESENTATION CONCERNING THE CONTENT WHEN USED IN ANY OTHER COUNTRY.
THE DATA AND INFORMATION IS PROVIDED "AS IS", AND ON AN "AS AVAILABLE" BASIS OR UNDER THE SPECIFIC PROVIDERS OWN TERMS AND THERE ARE NO CLAIMS, REPRESENTATIONS AND WARRANTIES MADE BY myLifeLog, EITHER EXPRESS, IMPLIED OR STATUTORY (TO THE EXTENT PERMITTED BY APPLICABLE LAW), WITH RESPECT TO THE SOFTWARE or DATA, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NOR ARE THERE ANY WARRANTIES CREATED BY COURSE OF DEALING, COURSE OF PERFORMANCE OR TRADE USAGE.

myLifeLog shall not be held responsible for any failure or malfunction in power or communications nor the failure or refusal of third party transmission intermediaries to perform, continue or renew their contractual arrangements with myLifeLog nor inability to perform caused by such or by labor strife, war, riot or other events beyond the control of myLifeLog. If the service or delivery thereof is disrupted by any such event(s), myLifeLog' obligations hereunder shall be suspended during the period of occurrence for such disrupting event(s).
Legal jurisdiction is California
This License as well as all disputes arising out of or in connection with this Agreement shall be governed by the laws of California, without regard to or application of choice of law rules or principles.
Any dispute arising out of or in connection with this License, or in future agreements resulting there from, shall be exclusively resolved before the competent court in California.
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding on-line conduct and acceptable data. Specifically, you agree to comply with all applicable laws regarding copyright and the transmission of technical data exported from the country in which you reside.
YOU AGREE TO INDEMNIFY, HOLD HARMLESS AND DEFEND myLifeLog, AND ITS AFFILIATES, OFFICERS, AGENTS, CO-BRANDERS OR OTHER PARTNERS, AND EMPLOYEES, AT YOUR EXPENSE, AGAINST ANY AND ALL THIRD PARTY CLAIMS OR DEMANDS, ACTIONS, PROCEEDINGS AND SUITS AND ALL RELATED LIABILITIES, DAMAGES, SETTLEMENTS, PENALTIES, FINES COSTS AND EXPENSES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEY'S FEES AND OTHER DISPUTE RESOLUTION EXPENSES) INCURRED BY myLifeLog, DUE TO OR ARISING OUT OF DATA OR INFORMATION YOU SUBMIT, POST TO OR TRANSMIT THROUGH THE WEBSITE, YOUR USE OR MISUSE OF THE DATA, INFORMATION, OR WEBSITE, YOUR CONNECTION TO OTHER USERS, YOUR VIOLATION OF THE LICENSE, OR YOUR VIOLATION OF ANY RIGHTS OF ANOTHER.
Changes in this agreement
myLifeLog shall review its terms and conditions periodically to reflect changes in the business or legal arena. myLifeLog reserves the right to change or modify any of the terms and conditions of this license and any of the policies governing the subscription data at any time in its sole discretion. We will notify you when these changes are made. If you do not agree to the changes, then you must stop using myLifeLog℠. Your continued use of the data following these changes will constitute your acceptance of such changes.
Termination of myLifeLog℠ Service
Your rights and access to the myLifeLog℠ website service under this License may be suspended or terminated automatically without prior notice from myLifeLog℠ if you fail to comply with any term(s) of this License. This suspension or termination may result in the deletion of your information, files, and other previously available content.
